I'm going to have a tough time taking about student loans in bankruptcy without getting ticked off. I'll keep my language under control, but this really bends me out of shape. Since the glory year of 1978, the ability to have student loans discharged has been very limited. Those lucky ducks before 1978 were able to have their student loans discharged, no questions asked. Now the standard is that student loans are not dischargeable in bankruptcy unless "undue hardship" exists. There have been cases of the court denying a single mom of 3 with health issues a discharge of student loans. Now in Ohio, the court has taken it to a new level. In Wallace v. Educational Credit Management Corp, the debtor had $32k in student loans, but his diabetes he'd had since he was 9 caused him gradually to become blind. Blind. He also required dialysis and kidney and pancreas transplants. Transplants -- plural. Next up was a prosthetic eye. He lived with his father on $811 a month. $800 a month -- that's Alpo for dinner money. The court said, "his physical condition appears to have stabilized." Sure, if that guy's not dead, he's stabilized. Then the court said: "it remains to be seen ... whether he will find work or remain unemployed." It remains to be seen -- that's really in the court's decision -- I kid you not. Really? I'm not sure that guy could drag is new kidney ...
